Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PRIVCOM Consulting websites, including privcom.ca, pocketsage.app, and all related products, downloads, and services (collectively, the “Services”).
By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree, do not use the Services.

1. Who We Are

PRIVCOM Consulting (“PRIVCOM,” “we,” “our,” “us”) is a Canadian privacy consultancy that develops and distributes the Pocket Sage offline AI assistant.

Pocket Sage is a local-only software product designed to run entirely on the user’s device, without cloud communication or data transmission.

2. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to use or purchase our Services.

By using the Services, you represent that:

• You have the legal authority to enter into these Terms

• You will comply with all applicable laws

• You are not using Pocket Sage for prohibited or high-risk activities (defined below)

3. Software License

When you purchase or download Pocket Sage, PRIVCOM grants you a:

• Personal,

• Non-exclusive,

• Non-transferable,

• Revocable license

to install and use the software on devices you own or control.

You may not:

• Resell or redistribute the software

• Reverse-engineer, decompile, or modify it

• Use it for training commercial models

• Use it to create derivative competing products without express permission

Pocket Sage is licensed, not sold.
All intellectual property remains the property of PRIVCOM Consulting.

4. No Cloud, No Telemetry : But Your Device Is Your Responsibility

Pocket Sage has no server connection, no telemetry, and no remote access.

This means:

• We do not store your prompts or data

• We cannot recover your lost transcripts

• We cannot see your activity

• We cannot monitor or supervise how you use the software

• YOU are responsible for securing your device, backups, and encryption

Pocket Sage gives you true sovereignty — but sovereignty comes with responsibility.

5. Acceptable Use

By using the Services, you agree not to:

• Use Pocket Sage for unlawful, harmful, or unethical purposes

• Attempt to bypass license protections

• Interfere with service operation

• Upload or distribute malicious code

• Use Pocket Sage to impersonate, defraud, or harass individuals

• Use Pocket Sage to generate illegal content

You agree to comply with your jurisdiction's privacy, intellectual property, and safety laws.

6. High-Risk Use Disclaimer

Pocket Sage is not designed or intended for:

• Medical diagnosis

• Emergency response

• High-risk clinical decisions

• Legal advice substitution

• Financial compliance determinations

• Military use

• Life-support systems

• Aviation or heavy-equipment control

If you use Pocket Sage in a way it was not designed for, PRIVCOM is not liable for any resulting harm.

Pocket Sage is a tool, not a professional substitute.

7. Updates, Changes & Technical Requirements

You acknowledge that:

• Pocket Sage may require periodic updates

• Hardware performance affects functionality

• Compatibility depends on your operating system

• PRIVCOM may discontinue support for older OS versions

We will notify users when significant changes or updates occur.

8. Refund & Cancellation Policy

Refunds may be issued only in accordance with applicable consumer protection laws in your jurisdiction.

Since Pocket Sage is a digital product that becomes fully functional upon installation, PRIVCOM may decline refunds after activation unless required by law.

For waitlist-based or pre-release purchases, refund terms will be clearly stated at time of payment.

9. Third-Party Content

Pocket Sage may process text or documents you upload locally on your device.
You are solely responsible for ensuring you have the rights to use such content.

PRIVCOM is not responsible for:

• Copyright violations

• Trademark misuse

• Misuse of third-party documents fed into Pocket Sage

10. Limitation of Liability

To the maximum extent permitted by law:

PRIVCOM Consulting is not liable for any:

• Indirect, incidental, or consequential damages

• Data loss (since data never leaves your device)

• Device malfunction

• Business interruption

• Loss of profits

• Errors generated by AI reasoning

You use Pocket Sage at your own risk.

Pocket Sage is provided “as is” and “as available” without warranties of any kind, express or implied.

11. Indemnification

You agree to indemnify and hold harmless PRIVCOM Consulting from any claims arising from:

• Your use or misuse of the Services

• Violation of these Terms

• Violation of applicable laws

• Infringement of third-party rights

You take full responsibility for your use of Pocket Sage.

12. Termination

PRIVCOM may suspend or terminate access if:

• You violate these Terms

• You attempt to misuse or redistribute the software

• Fraudulent behavior is detected

You may terminate at any time by discontinuing use and deleting the software.

13. Governing Law

These Terms are governed by the laws of Canada, specifically the Province of Québec, without regard to conflict-of-law principles.

Disputes may be resolved in Québec courts unless mutually agreed otherwise.

14. Changes to These Terms

We reserve the right to update these Terms periodically.
Updates will be posted on this page with a revised date.

Continued use of the Services constitutes acceptance of the updated Terms.
